Who is Ruchell Magee and why he has been in prison for 58 years

Ruchell Cinque Magee, a U.S. political prisoner who has served over 58 years in California prisons, was again denied parole July 15 by the state’s Board of Parole Hearings. Why won’t the state of California allow Magee to go free?

His story begins as a Black man from Louisiana, who since 1955 has had to deal with this racist injustice system. Magee remains in prison today because he participated in a bold, heroic action in an attempt to free political prisoners George Jackson, John Clutchette and Fleeta Drumgo, known as the Soledad Brothers, over 50 years ago. 

Magee grew up in Louisiana; and at the age of 16, he faced a racist conviction in 1955 for “attempted aggravated rape” for having a relationship with a white girl in an area dominated by the Ku Klux Klan. 

His conviction occurred at the same time that Emmett Till was lynched in Money, Miss., for supposedly whistling at a white woman. Magee was sentenced to eight years in Angola State Prison. He was legally ordered to leave Louisiana in 1962; and when finally released from Angola in 1963, Magee went to Los Angeles. (tinyurl.com/333jn64z) 

Magee was arrested that same year after a disagreement with someone about a $10 bag of marijuana. After his arrest, he was beaten so badly he had to be hospitalized for three days. He was then railroaded by the Superior Court of Los Angeles County, via extreme malpractice by both prosecution and defense attorneys, and sentenced to seven years to life in prison for a bogus charge of attempting to kidnap someone to commit robbery for $10. 

California built its vast prison system and exponentially increased its prison population of poor Black, Brown and Indigenous peoples by sentencing them to indeterminate sentences for petty theft and drug-related crimes. Magee was one of the victims of this racist and outrageous sentencing system. Once convicted, it was almost impossible to get parole during these years. 

Becoming politicized

Like George Jackson and so many other incarcerated Black people, Magee became politicized while inside, adding the middle name of “Cinque” after the African freedom fighter Cinqué, who led a rebellion on the slave ship La Amistad. Magee believed and stated, “Slavery 400 years ago, slavery today — it’s the same but with a new name.” 

He became known throughout the prison as a jailhouse lawyer. He filed a wrongful death lawsuit and helped win a big settlement for the family of Fred Billingsly, who was tear-gassed and beaten to death by San Quentin guards while in his cell in February 1970. 

On August 7, 1970, Jonathan Jackson, the 17-year-old brother of George Jackson, burst into a Marin County courtroom armed with guns with the intention of taking over the courtroom to demand the release of the Soledad Brothers. They were charged with killing a white guard at Soledad State Prison, notoriously known for racist murders and brutality against Black and Brown prisoners. 

Three prisoners, William Christmas, James McClain and Magee, who were in the courtroom that day, joined the escape attempt. Magee and Christmas were in court to testify in support of McClain, who was facing charges for assaulting a guard at Soledad after the Billingsly murder. 

Jackson and the three prisoners took several hostages, including Judge Harold Haley, Deputy District Attorney Gary Thomas and three jurors, and attempted to escape in a van. The San Quentin guards fired into the van, killing everyone but Magee and the prosecutor, who were both badly wounded. 

This August 7 will mark the 51st anniversary of Jonathan Jackson’s heroic effort to free his brother and two other political prisoners.  

Magee wrote, Once the facts can be clearly established and shown to the people, where these dogs are practicing slavery under the color of law, then this automatically requires a special investigation by the people to look for themselves. They will find that these judges are criminals.” (freeruchellmagee.org/about) 

Magee wanted to conduct a very political trial that challenged the validity of the prison system and recognized his right like Cinque’s to fight for his freedom against slavery. 

The legal team of Magee’s co-defendant Angela Davis, who was facing charges for supposedly purchasing the weapons used in the courthouse action, had a different legal strategy and separated the cases. Magee went on alone in his legal defense battle, eventually defending himself pro se. 

Fortunately the murder charges were dropped, but he was convicted of “simple kidnap.” The verdict in the more serious kidnapping charge was disputed, and Magee believes he was acquitted of that charge. (tinyurl.com/6fpweaf4)

Magee was sentenced in 1975 to life in prison and has gone before the parole board many times since then. Each time, he has been denied parole. He is now 82 years old, having served over 58 years in prison, and is now incarcerated at the California Medical Facility.

The Coalition to Free Ruchell Magee, the Jericho Movement and other groups organized a groundswell of support for Magee during his last parole effort July 15. A current petition to California Governor Gavin Newsom to grant clemency for Magee states: “As an elder, he faces constant mental and physical health risks every day from nearly six decades of incarceration. With the COVID-19 pandemic raging across California’s prisons throughout 2020 and 2021, Ruchell has been in significant danger of falling ill.” (tinyurl.com/5hf9xty2)

Incarcerated people in California’s prisons have suffered high COVID infection rates and deaths due to the prison system’s refusal to stop transfers and cell extractions and to provide adequate medical care to people inside.

Magee, Sundiata Acoli, Mutulu Shakur, Russell Maroon Shoatz, Mumia Abu-Jamal, David Gilbert and Leonard Peltier are some of the aging political prisoners who have served decades of time for their bold defiance of racist murder and injustice. This year, 2021, has been designated the Year of the Political Prisoner. It’s time to free Ruchell Cinque Magee and free them all!

BLACK AUGUST

 There are people who decry the fact that racism is "still here", but the truth is, is that as long as a system that is built upon racism and needs it to exist still dominates and exploits the entire world , it's not going to disappear any time soon.
Black August has a foundation that will not be shaken, no matter how much the powers that be have tried and continue to try to drown the Revolutionaries in blood.

 

Black August: A tribute to freedom fighters

The March on Washington for Jobs and Freedom on Aug. 28, 1963, galvanized hundreds of thousands in the streets of Washington, D.C. A. Philip Randolph helped to establish the Brotherhood of Sleeping Car Porters in Harlem, N.Y., on Aug. 25, 1925. The Haitian Revolution first broke the chains of French colonialism in August 1791. August marks the Nat Turner slave rebellion of 1831 and the Watts Uprising of 1965. The Philadelphia Police Department first raided the MOVE organization on Aug. 8, 1978, giving way to the unjustly imprisoned MOVE 9. August also bears the births of Fred Hampton, Marcus Garvey and Mutulu Shakur.

“Black August” is a month long celebration that marks the remembrance of the lives of freedom fighters who gave their all for Black liberation, freedom, radical resistance and mass consciousness. The official origin of Black August was in honor of the fallen soldiers who valiantly fought to liberate Black Panther leader George Lester Jackson from the modern-day slave trade we now call the U.S. penal system.

Black freedom fighters — James McClain, William Christmas, Ruchell Magee, Khatari Gaulden and 17-year-old Jonathan Jackson — the brother of George Jackson — led a courthouse rebellion on Aug. 7, 1970, in a brave display of all-out resistance and armed struggle. Unfortunately, lives were lost as they typically are in any war for liberation. Magee, who is currently still incarcerated, was the only survivor. And though our heralded comrade, George Jackson, was not freed, the efforts of Jonathan and others would inspire decades of continued resistance and revolutionary solidarity.

George Jackson had just completed his book “Soledad Brother,” a philosophical revolutionary classic. Jackson, however, was assassinated by San Quentin prison guards one year later on Aug. 21, 1971. His second book, “Blood in My Eye,” was published posthumously by Black Classic Press. Jackson’s legacy of resistance has inspired millions worldwide, while his literary works continue to teach even in his physical absence.

This is the background in which Black August was first formed. It was deep within the belly of the California penal system that it was first embraced and formally established as a month of reverence, as a time of revolutionary celebration.

The heroic Attica prison rebellion which began on Sept. 9, 1971, and was eventually drowned in blood by Gov. Nelson Rockefeller’s stormtroopers (the N.Y. state police), with the deaths of over 40 unarmed prisoners, was sparked by Jackson’s assassination.

Incarcerated workers today have continued to protest and press forward all over the United States. Hunger strikes over the past year have roused hundreds of thousands in states such as California, Georgia and North Carolina. Letter writing campaigns have served as vital lines of inspiration and direct communication. ­Human rights activists such as political prisoner Mumia Abu-Jamal have served as critical catalysts, tirelessly working to empower the voices of those who continue to be oppressed by the public and private prison industry.

Today, in the spirit of continued resistance, we honor the deaths of Mark Clark, Fred Hampton and Geronimo Pratt. We honor the sacrifices and life work of political prisoners Eddie Conway, Sundiata Acoli and our freedom fighters in exile like Assata Shakur. We honor the countless victims of COINTELPRO’s callous attacks upon the people. We duly recognize the destructive ills of capitalism and its disastrous effects upon the oppressed worldwide. In the age of the prison-industrial complex, school-to-prison pipeline and widespread police brutality, the struggle for justice and liberation is alive now more than ever.

In the 42nd year of Black August, may we all take heed to the spirited words of our brother and mentor, George Lester Jackson: “Settle your quarrels; come together; understand the reality of our situation; understand that fascism is already here, that people are dying who could be saved.” (“Soledad Brother”)

Females 12-17 years of age are 72% more likely to die from the vaccine than from Covid.

The lying scum presstitutes, medical bureaucrats, and shills who are paid to lie for Big Pharma are trying to claim that the case surge in vaccinated countries is the new “Delta variant” while simultaneously claiming that the vaccines protect against the “Delta variant.” 

CDC director Rochelle Walensky claims falsely that “if you are fully vaccinated you are protected against severe COVID, hospitalization and death, and are even protected against the known variants, including the delta variant, circulating in this country.”  Independent scientists are suggesting that the surge in cases among vaccinated countries is caused by the vaccine itself which releases the Spike Protein into the body as does the virus.  The presstitutes continue to hide the facts, and independent experts sounding alarm continue to be censored, ridiculed, and threatened with firings.

An unfolding health catastrophe is being covered up as it happens before our eyes.

Here is the latest CDC report on adverse vaccine effects.  Remember the VAERS reporting system captures at best only 10% of the adverse vaccine reactions.  

Here is a report claiming deaths are seriously under-reported by VAERS.  As the print, TV, and NPR media are 100% unreliable along with a high percentage of the Internet media, it is difficult to know what to make of this report.

A month ago I posted Dr. Robert Malone’s concern about the dangers the vaccines present to many elements of the population.  

The grave problem that we face is that almost the entirety of the medical profession, governments, and media are invested 100% in the hype that the vaccines are the answer. They continue to call the high and rising number of deaths and adverse effects of the vaccines “rare.”

They are now blaming the astonishing number of new cases among heavily-vaccinated populations on a mutation or new variant. It is beyond their capability to consider if the vaccine itself is the cause of the new outbreak.  People this culpable in mass deceit, murder, and injuries are incapable of recognizing their mistake.  As incompetent or corrupt governments shielded the vaccine-makers from liability, there is no help for the families of those killed by the vaccine and no medical help for those injured by the vaccine.  As the corrupt medical establishment will not recognize the dangers of the vaccines, no research is being done about how to cure or ameliorate the health problems caused by the vaccines.  Instead, the health establishment continues to press forward with vaccination with many employers and universities mandating vaccination and the fool in the Oval Office wanting to send agents door-to-door to vaccinate “anti-vaxxers.” France and Greece are trying to impose Covid Passports in order to coerce their entire populations to accept vaccination with an untested, experimental, and now proven highly dangerous vaccine. Biden Demands Facebook Silence Everyone Who Questions Covid Vaccine —  see this.

We are everywhere witnessing the complete and total failure of government and public health bureaucracies.

Some doctors and scientists are concerned that the Spike proteins in the vaccines that attack the body’s vital organs will result in a high percentage of those vaccinated dying within three years, with the consequence being the collapse of societies.  Indeed, it could be too late to retrieve the situation, and the establishment is in total denial.

First Nations leaders decry 

'racist political propaganda'

First Nations representatives harshly called out the Manitoba government on Monday, labelling recent comments by Premier Brian Pallister and cabinet minister Alan Lagimodiere as propaganda and demanding the latter's resignation.

Standing on the front steps of the legislative building, the Summit of Treaty 5 Sovereign Nations (STFSN) blasted the Progressive Conservative government for a "deliberate attempt to distort the history of Indigenous peoples regarding the policy of genocide at residential schools."

In a fiery speech that could be heard far from the Tyndall stone steps, Grand Chief Arlen Dumas of the Assembly of Manitoba Chiefs shouted his anger with Pallister and Lagimodiere.

"We found 1,505 children murdered in these schools, hidden and buried in the ground, and in the same breath, [you] say 'but residential schools were a good thing. Assimilation was a good thing.' Who can say that in their right mind?" he said.

"Here we are today trying again to have people who are so ill-informed and uninformed and uneducated [and] ignorant, tell my mother that what happened to her in residential school, it was OK."

Dumas spoke of how Indigenous people showed the first European settlers how to travel and survive in a land and climate that could be inhospitable at times.

"Where we treated your ancestors like human beings, your institutions treated us like savages," he yelled.

The comments by Pallister and Lagimodiere suggest nothing is changing, Dumas said.

"I'm tired of talking to Pallister. I give him every opportunity to have meaningful dialogue. We bring forward meaningful solutions to work together, hand in hand, to move forward. But he'd rather talk at me."

During a Canada Day rally in Winnipeg, following the discovery of unmarked graves at former residential schools in Canada, statues of Queen Victoria and Queen Elizabeth were pulled down on the grounds of the Manitoba Legislature.

Pallister denounced the actions and made comments that suggested the colonization of Canada was done with good intentions.

The people who came to Canada "didn't come here to destroy anything. They came here to build. They came to build better," he said, adding the statues would be repaired and set back up, though the locations might change.

In a news release, the STFSN said the premier's comments are "racist political propaganda distorting and romanticizing colonialism."

"If Pallister wants to rebuild that statue so quickly, a statue that some of my non-First Nations friends in Manitoba didn't even know the significance of, then he may as well be building them on those graves," Dumas said.

Remarks prompted minister to step down

Pallister's remarks provoked the resignation of his own Indigenous and northern relations minister, Eileen Clarke, who stepped down from her cabinet position two days later.

In doing so, Clarke said many Manitobans are disappointed with their representatives, and added that she and other cabinet ministers had not been listened to.

She was replaced by Lagimodiere, who, within 10 minutes of his appointment on July 15, told reporters the people who ran Indian residential schools believed "they were doing the right thing."

"In retrospect, it's easy to judge in the past. But at the time, they really thought that they were doing the right thing," he said.

"From my knowledge of it, the residential school system was designed to take Indigenous children and give them the skills and abilities they would need to fit into society as it moved forward."

Lagimodiere has since apologized, saying his words were wrong, but the fallout has continued.

Two Indigenous men, Jamie Wilson and Darrell Brown, quit their positions on Manitoba economic development boards shortly after Lagimodiere's comments. Wilson had previously served as a deputy minister in two departments under the Progressive Conservative government and was the treaty commissioner for Manitoba.

"There is no way to sugarcoat the intent and effect of the residential school [system]. It was purposefully designed and carried out to impose forcible, punitive assimilation on every First Nation child they could lay hands on," said AMC regional chief Cindy Woodhouse.

"The Indian residential school system was all about denigrating First Nations cultures, First Nations languages, values and First Nations everything. That's why there are thousands of children who disappeared without a trace. They were devalued in death as they were in life."

There is no such thing as benign colonialism, or well-intentioned colonialism and governments cannot move on from that dark past by denying the truth, she said.

"At a time when our people are recovering children's bodies and our survivors are finally starting to be acknowledged by the general public, the comments by the PC government has caused a setback by the use of such irresponsible and volatile words," said Chief Clarence Easter of Chemawawin Cree Nation.

"We are stepping to the plate to deal with this."

Action plan calls for new minister to step down

The action plan unveiled by the STFSN calls for alliances between the Treaty 5 First Nations and affiliate organizations to work together to respond to hate crime and racism.

Treaty 5 includes more than 100,000 people from 37 First Nations in Manitoba and three in Saskatchewan, according to the STFSN.

The plan calls for the following:

  • Hate crimes and racism should be standing discussion items at every annual gathering of Treaty 5 Nations, beginning Aug. 10.

  • To promote non violence and avoid destruction of property.

  • To develop a report on hate crimes and racism and report them to the United Nations.

  • To conduct an awareness campaign on the prevalence and effects of hate crimes and racism.

  • To lobby the federal government to do more to criminalize hate crimes and racism, saying the Criminal Code currently does little to deter it.

  • To condemn and publicly expose hate crimes and racism and hate propaganda through First Nations social media.

  • To create a task force of academics, elders and youth to enact the actions.

"Today we are not here to topple any statues, we are here to topple a government that is racist, a government that has no place in this legislature," said Garrison Settee, Grand Chief of Manitoba Keewatinowi Okimakanak, which represents 26 First Nations in northern Manitoba.

One of the first actions in the plan on Monday was to call for Lagimodiere to step down from his cabinet position.

"Dr. Alan Lagimodiere proved himself as an embarrassment to reconciliation and Indigenous relations," said Chief Sheldon Kent of Black River First Nation.

"His comments were harmful, retriggering anger and discontent among our people. There was no good intention at Indian residential schools to promote and it is catastrophically irresponsible to suggest otherwise.

"We call for his resignation and he must step down."

AGAIN AND AGAIN

It has always been an uneven relationship based on domination , so why would anyone think it's any different now ? It isn't.

Turmoil no excuse for invasion

In Haiti, around 1:00 a.m., July 7, brand new SUVs without license plates pulled up to the private residence of President Jovenel Moïse in Pétion-Ville. A team of assassins got out, slipped through his security and shot him dead. His spouse was severely injured.

Since 2019 Haitian people have been taking to the streets by the millions in protests and general strikes against labor exploitation and U.S. interference in their government–here in La Croix in March.

President Joe Biden has expressed reluctance to openly intervene in the chaos that puppets and allies of the U.S. have created in Haiti. Nevertheless, U.S. imperialism’s responsibility for the deadly, contentious situation following the assassination of President Jovenel Moïse is clear.

The real details of the assassination — who did it, who paid for it, what were their motives — are murky. The Haitian National Police (PNH) have charged 20 Colombian citizens and two U.S. citizens of Haitian origin with participating in the attack. 

Some Colombians were arrested inside the Taiwanese embassy where they had taken refuge; others were arrested at the hospital where they had taken Moïse’s daughter and spouse.

No reports say whether any of Moïse’s security guards, who were drawn from elite units of the PNH, were injured in the attack. The PNH postponed interviewing their leading officials until some time during the week of July 11, at least four days after the attack. The PNH announced July 11 that some guards involved had been placed under house arrest.

Claude Joseph, whom Moïse appointed prime minister in April, now claims he gives orders to the 15,000 cops and the 500 army troops of the country. Dr. Ariel Henry was scheduled to replace Joseph on the day of the assassination. Because the president, Moïse, had been killed, Henry was unable to be sworn in. 

Both Joseph and Henry claim to be acting president. The U.S. government and the United Nations, whose special representative in Haiti is Helen La Lime, have recognized Joseph as Haiti’s president. Before she was appointed to the U.N., La Lime was U.S. ambassador to Angola.

Why should the U.S. decide?

The question that patriotic Haitians have to ask is: Who gave the U.S. and the U.N. the authority to determine Haiti’s president? Whatever is decided, both Claude Joseph and Ariel Henry have strong connections to the United States. 

When he was a student leader in Haiti, Joseph received substantial funding from the National Endowment for Democracy, which is a tool of U.S. intervention. Later, Joseph got his doctorate from the New School and taught in New York and Connecticut. One of the first steps Joseph took as acting president was to request U.S. soldiers be sent to Haiti.

Henry served as minister of interior and territorial communities and was politically active organizing around the second coup d’état against elected President Jean-Bertrand Aristide on Feb. 29, 2004. U.S.-based mercenaries carried out that coup, kidnapping and taking Aristide to the Central African Republic. 

On paper, Haiti is a parliamentary democracy. Right now, it has no functioning parliament. Its government has been hollowed out, leaving 10 senators the only elected office holders for this country of 11 million people. 

This hollowing was done deliberately by Moïse, with full and unequivocal U.S. backing, so he could run the country by decree. During the past year, hundreds of thousands of ordinary Haitians have been in the streets protesting Moïse’s attempt to use U.S. support to stay in power.

In a July 6 statement, Black Alliance for Peace put a price tag on this support: The U.S. “has spent at least $12.6 million since Moïse was elected in support of dubious elections and bogus political processes.”

Without a parliament to grant its approval, all the prime ministers whom Moïse appointed were unconstitutional. Much of what they did may be challenged legally.

All the other officials in Haiti — members of the National Assembly (the lower house of parliament), mayors, councillors, boards of all sorts — had their mandates expire by February of 2021 or earlier. President Moïse postponed the elections that would have renewed their mandates and instead appointed his choices to be mayors and local officials.

On July 9, eight of the ten serving Haitian senators met and elected yet another provisional president, the chair of the Senate, Joseph Lambert.

Black Alliance for Peace has pointed out that “[t]he Haitian people must be allowed to exercise self-determination and address their internal political situation without interference.” 

Since what the U.S. and France have done has caused tremendous economic and financial hardship to Haiti, the ongoing Haitian demand for full and fair reparations is certainly justified
